Vlasnik sam brodice koju sam registrirao za gospodarske namjene jer je ljeti iznajmljujem. Koristio bih je i izvan sezone za osobne potrebe, ali ne znam jesam li u nekom prekršaju ako isplovljenje nisam prijavio. Iskreno, jednom sam poželio isploviti u lov na lignje, ali čim sam promislio na administrativne obaveze, izgubio sam volju. Je li moguća nekakva dvojna registracija brodice i koji se sve prekršaji riskiraju kada se brodica koristi u druge svrhe?

Odlično pitanje, toliko dobro da ni u nadležnom Ministarstvu mora, prometa i infrastrukture na njega nemaju odgovor. Zašto, ne znam, ali čini se logičnim da biste svoju brodicu koja je izvan sezone na vezu morali bez nekih administrativnih poteškoća moći koristiti i za osobne potrebe, pa i za sportski ribolov. U suprotnom, trebali biste imati dvije brodice, jednu za rad, a drugu za razonodu. Dio godine koristite jednu, a drugi dio godine drugu. Osim što je to dvostruki trošak, jedna je uvijek mrtvi kapital na vezu.

Za sada u Republici Hrvatskoj imamo tri namjene brodice, za osobne potrebe, za gospodarske namjene i javne brodice. Nikakva dvojna registracija nigdje se ne spominje. Neki su ranije ovom problemu doskočili tako što su svoje plovilo dio godine registrirali za gospodarsku namjenu, a nakon sezone za osobne potrebe, stalno mijenjajući registracijsku oznaku. Sada je to nešto jednostavnije jer donošenjem novog Pravilnika o brodicama, čamcima i jahtama registracijska oznaka sadrži nacionalni identifikacijski broj (NIB) i dva slova luke upisa koji se na brodicama za osobne potrebe nalaze ispred broja, a na onima za gospodarske namjene iza broja.

Redovni pregled

Aktualnim Pravilnikom plovila za višednevni boravak na moru više ne mogu imati trajnu registraciju, već moraju obaviti prvi i kasnije periodične tehničke preglede. Obim i periodi obavljanja pregleda ovise o namjeni i starosti brodice. Redovan pregled brodica za gospodarske namjene obavezan je svake dvije, brodicama za osobne potrebe svakih pet godina, a kada se brodicu za osobne potrebe želi prenamijeniti za gospodarske namjene, potrebno je obaviti izvanredan tehnički pregled. Dakle, ako ste za svoju brodicu na početku sezone napravili redovan tehnički pregled i na kraju sezone svoju brodicu želite prenamijeniti za osobne potrebe, izvanredni tehnički pregled nije obavezan. Međutim, nije jasno da li kod ponovne promjene namjene pred iduću sezonu ovaj lanjski pregled vrijedi ili je potrebno raditi novi.

Dodatnu nedoumicu može donijeti i sam formular za upis, Zahtjev za upis brodice ili jahte do 24 metra u Upisnik brodova. Naime, u obrascu je potrebno navesti osnovnu namjenu plovila, a neposredno ispod po potrebi i jednu sporednu namjenu. Znači li to da se u ovakvom slučaju za osnovnu namjenu može upisati za osobne potrebe, a za sporednu za gospodarske namjene ili obrnuto? Ako da, koje bi tada bile dodatne obaveze vlasnika u odnosu na to kada je plovilo registrirano samo za jednu namjenu? Ako ne, što se uopće podrazumijeva pod ovim sporedna namjena?

Godišnji trošak

Ovdje se nametnulo još nekoliko pitanja koja se ne mogu baš jasno iščitati iz Pravilnika. Koji se prekršaji riskiraju kada se plovilo koristi u svrhe različite od registrirane namjene? Nadalje, ako nije moguća nekakva dvojna registracija, na koji način vlasnik brodice treba postupiti da bi u duhu svih zakona i pravilnika mogao imati plovilo koje jedan dio godine može koristiti za osobne potrebe? Treba li ga svake godine pred sezonu registrirati za gospodarske namjene, a nakon sezone za osobne potrebe? Ako da, da li lanjski redovni pregled brodice za gospodarske namjene vrijedi i za ovu godinu? Koliki je uopće ukupni godišnji trošak za ove izmjene?

Sva sam ova pitanja poslao nadležnom ministarstvu još u studenome prošle godine, međutim, na sva moja nastojanja i požurnice nisu mi poslali nikakav odgovor. Muk. Zašto, ne znam.

Vlasnik sam brodice koju sam registrirao za gospodarske namjene jer je ljeti iznajmljujem. Koristio bih je i izvan sezone za osobne potrebe, ali ne znam jesam li u nekom prekršaju ako isplovljenje nisam prijavio. Iskreno, jednom sam poželio isploviti u lov na lignje, ali čim sam promislio na administrativne obaveze, izgubio sam volju. Je li moguća nekakva dvojna registracija brodice i koji se sve prekršaji riskiraju kada se brodica koristi u druge svrhe?

Odlično pitanje, toliko dobro da ni u nadležnom Ministarstvu mora, prometa i infrastrukture na njega nemaju odgovor. Zašto, ne znam, ali čini se logičnim da biste svoju brodicu koja je izvan sezone na vezu morali bez nekih administrativnih poteškoća moći koristiti i za osobne potrebe, pa i za sportski ribolov. U suprotnom, trebali biste imati dvije brodice, jednu za rad, a drugu za razonodu. Dio godine koristite jednu, a drugi dio godine drugu. Osim što je to dvostruki trošak, jedna je uvijek mrtvi kapital na vezu.

Za sada u Republici Hrvatskoj imamo tri namjene brodice, za osobne potrebe, za gospodarske namjene i javne brodice. Nikakva dvojna registracija nigdje se ne spominje. Neki su ranije ovom problemu doskočili tako što su svoje plovilo dio godine registrirali za gospodarsku namjenu, a nakon sezone za osobne potrebe, stalno mijenjajući registracijsku oznaku. Sada je to nešto jednostavnije jer donošenjem novog Pravilnika o brodicama, čamcima i jahtama registracijska oznaka sadrži nacionalni identifikacijski broj (NIB) i dva slova luke upisa koji se na brodicama za osobne potrebe nalaze ispred broja, a na onima za gospodarske namjene iza broja.

Redovni pregled

Aktualnim Pravilnikom plovila za višednevni boravak na moru više ne mogu imati trajnu registraciju, već moraju obaviti prvi i kasnije periodične tehničke preglede. Obim i periodi obavljanja pregleda ovise o namjeni i starosti brodice. Redovan pregled brodica za gospodarske namjene obavezan je svake dvije, brodicama za osobne potrebe svakih pet godina, a kada se brodicu za osobne potrebe želi prenamijeniti za gospodarske namjene, potrebno je obaviti izvanredan tehnički pregled. Dakle, ako ste za svoju brodicu na početku sezone napravili redovan tehnički pregled i na kraju sezone svoju brodicu želite prenamijeniti za osobne potrebe, izvanredni tehnički pregled nije obavezan. Međutim, nije jasno da li kod ponovne promjene namjene pred iduću sezonu ovaj lanjski pregled vrijedi ili je potrebno raditi novi.

Dodatnu nedoumicu može donijeti i sam formular za upis, Zahtjev za upis brodice ili jahte do 24 metra u Upisnik brodova. Naime, u obrascu je potrebno navesti osnovnu namjenu plovila, a neposredno ispod po potrebi i jednu sporednu namjenu. Znači li to da se u ovakvom slučaju za osnovnu namjenu može upisati za osobne potrebe, a za sporednu za gospodarske namjene ili obrnuto? Ako da, koje bi tada bile dodatne obaveze vlasnika u odnosu na to kada je plovilo registrirano samo za jednu namjenu? Ako ne, što se uopće podrazumijeva pod ovim sporedna namjena?

Godišnji trošak

Ovdje se nametnulo još nekoliko pitanja koja se ne mogu baš jasno iščitati iz Pravilnika. Koji se prekršaji riskiraju kada se plovilo koristi u svrhe različite od registrirane namjene? Nadalje, ako nije moguća nekakva dvojna registracija, na koji način vlasnik brodice treba postupiti da bi u duhu svih zakona i pravilnika mogao imati plovilo koje jedan dio godine može koristiti za osobne potrebe? Treba li ga svake godine pred sezonu registrirati za gospodarske namjene, a nakon sezone za osobne potrebe? Ako da, da li lanjski redovni pregled brodice za gospodarske namjene vrijedi i za ovu godinu? Koliki je uopće ukupni godišnji trošak za ove izmjene?

Sva sam ova pitanja poslao nadležnom ministarstvu još u studenome prošle godine, međutim, na sva moja nastojanja i požurnice nisu mi poslali nikakav odgovor. Muk. Zašto, ne znam.
