Brodosplit je na korak do stečaja: Trgovački sud obustavio je predstečajni postupak nad krovnim škverskim poduzećem i postane li to sudsko rješenje pravomoćno, postupak će se nastaviti kao da je Tomislav Debeljak predložio otvaranje stečaja nad svojim brodogradilištem.
To bi se moglo razriješiti ujesen, sredinom listopada, budući da Brodosplit najprije ima petnaestak dana roka za žalbu Visokom trgovačkom sudu u Zagrebu, a taj još dva mjeseca za konačnu odluku.
Ako zagrebački sud potvrdi splitsko rješenje, škveru ne slijedi automatski stečaj. Prije toga održat će se barem jedno ročište na kojemu će se utvđivati jesu li nastupili stečajni razlozi. Debeljaka - u tom slučaju - od stečaja može spasiti samo pedesetak milijuna kuna kojima bi na jedan dan deblokirao Brodosplitov račun i istog tog dana podnio novi prijedlog za otvaranje novog predstečaja.
Možda i nešto manje novca, jer su najmanje polovicu spomenitih blokada Fini uputile tvrtke povezane s brodogradilištem i njegovim samoborskim vlasnikom. Pa bi svoje blokade mogli dogovorno povući.
Toliko zasad o varljivoj budućnosti, vratimo se na sigurnu sadašnjost i razloge suca Ivana Čulića za obustavljanje predstečaja. Ukratko, prihvatio je argumentiran prijedlog predstečajnog povjerenika Matea Puljića.
U jednoj rečenici: Brodosplit je kršio zakonske odredbe propisane tako posrnulim tvrtkama, plaćajući račune koje nije smio, a izbjegavajući platiti one koje je morao. Ignorirajući pri tom povjerenikove upute i onemogućivši mu obavljanje nadzora.
Puljić je dvaput predlagao prekid predstečaja. Ustanovio je, naprimjer, da škver u predastečaju nije podmirio poreza na dodanu vrijednost u iznosu od gotovo sedam milijuna kuna, iako je imao dovoljno novca, ali je istodobno plaćao usluge koje nisu nužne za poslovanje, kao što su paušali odvjetnicima ili raznim vanjskim suradnicima. Među kojima samo jednom odvjetničkom društvu čak 165.000 kuna mjesečno.
Navodi se i potpuno nevjerojatna situacija u kojoj škver angažira i plaća privatnu tvrtku da mu vodi projekt izgradnje broda koji je u stvarnosti odavno isporučen – čak prije tri godine. Radi se o malom polarnom kruzeru Hondius.
Sudac nije prihvatio tumačenja Debeljakovih odvjetnika, obrazlažući detaljno zašto. Recimo da je Brodosplitov tim bio tražio da sud promijeni povjerenika, žaleći se da nema dovoljno stručnog znanja ni pojma o tomu kako posluje i kako se vodi jedno brodogradilište. Uz brojne druge zamjerke.
No, pokazalo se upravo suprotno - još nepravomoćno, doduše - da upravo Brodosplit i njegov tim odvjetnika (koje Debeljak u predstečaju plaća, jer mu "zamjenjuju čitavu pravnu službu") ne posluju kako bi trebalu u nezavidnom položaju u kakvom su se našli.
Predstečajno ročište za utvrđivanje tražbina, prethodno sazvano za 7. rujna, sada nema smisla, pa se neće ni održati.
Ukratko: čeka se teška jesen. Naravno, pod uvjetom da uloži žalbu u Zagrebu. Dotle nije zgoreg ponoviti, a da ne bi bilo zabune. Brodosplit, krovno poduzeće splitskog škvera čeka hoće li završiti u stečaju, jer mu je upravo obustavljen predstečaj.
Istovremeno, na istom sudu u Splitu vodi se niz stečajnih postupaka nad tridesetak škverskih tvrtki kćeri, kojima je Brodosplit osnivač. Upravo ta društva imaju najveći broj zaposlenih. Glavnina njih ostat će bez posla, a tvrtke će biti likvidirane. Izbrisane. Neke već jesu.

Brodosplit je na korak do stečaja: Trgovački sud obustavio je predstečajni postupak nad krovnim škverskim poduzećem i postane li to sudsko rješenje pravomoćno, postupak će se nastaviti kao da je Tomislav Debeljak predložio otvaranje stečaja nad svojim brodogradilištem.
To bi se moglo razriješiti ujesen, sredinom listopada, budući da Brodosplit najprije ima petnaestak dana roka za žalbu Visokom trgovačkom sudu u Zagrebu, a taj još dva mjeseca za konačnu odluku.
Ako zagrebački sud potvrdi splitsko rješenje, škveru ne slijedi automatski stečaj. Prije toga održat će se barem jedno ročište na kojemu će se utvđivati jesu li nastupili stečajni razlozi. Debeljaka - u tom slučaju - od stečaja može spasiti samo pedesetak milijuna kuna kojima bi na jedan dan deblokirao Brodosplitov račun i istog tog dana podnio novi prijedlog za otvaranje novog predstečaja.
Možda i nešto manje novca, jer su najmanje polovicu spomenitih blokada Fini uputile tvrtke povezane s brodogradilištem i njegovim samoborskim vlasnikom. Pa bi svoje blokade mogli dogovorno povući.
Toliko zasad o varljivoj budućnosti, vratimo se na sigurnu sadašnjost i razloge suca Ivana Čulića za obustavljanje predstečaja. Ukratko, prihvatio je argumentiran prijedlog predstečajnog povjerenika Matea Puljića.
U jednoj rečenici: Brodosplit je kršio zakonske odredbe propisane tako posrnulim tvrtkama, plaćajući račune koje nije smio, a izbjegavajući platiti one koje je morao. Ignorirajući pri tom povjerenikove upute i onemogućivši mu obavljanje nadzora.
Puljić je dvaput predlagao prekid predstečaja. Ustanovio je, naprimjer, da škver u predastečaju nije podmirio poreza na dodanu vrijednost u iznosu od gotovo sedam milijuna kuna, iako je imao dovoljno novca, ali je istodobno plaćao usluge koje nisu nužne za poslovanje, kao što su paušali odvjetnicima ili raznim vanjskim suradnicima. Među kojima samo jednom odvjetničkom društvu čak 165.000 kuna mjesečno.
Navodi se i potpuno nevjerojatna situacija u kojoj škver angažira i plaća privatnu tvrtku da mu vodi projekt izgradnje broda koji je u stvarnosti odavno isporučen – čak prije tri godine. Radi se o malom polarnom kruzeru Hondius.
Sudac nije prihvatio tumačenja Debeljakovih odvjetnika, obrazlažući detaljno zašto. Recimo da je Brodosplitov tim bio tražio da sud promijeni povjerenika, žaleći se da nema dovoljno stručnog znanja ni pojma o tomu kako posluje i kako se vodi jedno brodogradilište. Uz brojne druge zamjerke.
No, pokazalo se upravo suprotno - još nepravomoćno, doduše - da upravo Brodosplit i njegov tim odvjetnika (koje Debeljak u predstečaju plaća, jer mu "zamjenjuju čitavu pravnu službu") ne posluju kako bi trebalu u nezavidnom položaju u kakvom su se našli.
Predstečajno ročište za utvrđivanje tražbina, prethodno sazvano za 7. rujna, sada nema smisla, pa se neće ni održati.
Ukratko: čeka se teška jesen. Naravno, pod uvjetom da uloži žalbu u Zagrebu. Dotle nije zgoreg ponoviti, a da ne bi bilo zabune. Brodosplit, krovno poduzeće splitskog škvera čeka hoće li završiti u stečaju, jer mu je upravo obustavljen predstečaj.
Istovremeno, na istom sudu u Splitu vodi se niz stečajnih postupaka nad tridesetak škverskih tvrtki kćeri, kojima je Brodosplit osnivač. Upravo ta društva imaju najveći broj zaposlenih. Glavnina njih ostat će bez posla, a tvrtke će biti likvidirane. Izbrisane. Neke već jesu.
