Korisnik sam godišnjeg veza u marini i do ove godine nisam imao nikakvih problema. Ranije je moj brod bio privezan uvijek na istome mjestu, ispred recepcije, a lani mi je dodijeljen drugi vez, na drugom kraju marine.

Prije ljeta došao sam pripremiti brod i vidio da mi je jedan bok izgreban, a sidro s pramca i još neka oprema iz kokpita ukradeni.

Od marine sam zatražio odštetu, međutim, rekli su mi da na to nemam pravo. Je li to točno?

Ako ste korisnik godišnjeg veza, onda sigurno imate i ugovor u kojem su navedeni odnosi i obaveze vas i marine. To je praksa koju za korisnike mjesečnog ili godišnjeg veza koriste sve marine. Ovi ugovori nisu pravno regulirani posebnom zakonskom odredbom, ali su se kroz poslovnu praksu pojedine marine donekle definirali njezini opći uvjeti poslovanja.

Kako sve marine nisu jednako organizirane, tako ni njihovi uvjeti poslovanja nisu ujednačeni ni standardizirani, a često ni dovoljno precizni ni dorečeni. Jedna od posljedica toga može biti i neujednačena sudska praksa.

Različite odredbe

Ugovori koje koristi većina marina u mnogim su stavkama vrlo slični, međutim, u nekima se i dosta razlikuju. Gotovo u svim ugovorima marine uglavnom preuzimaju odgovornost i nadoknadit će trošak za štete koje su prouzročili njezini djelatnici pri obavljanju poslova, a nikako za štete koje su nanijele treće osobe.

Neke će marine preuzeti odgovornost i za opremu koja je ukradena provalom ili drugim oblikom nasilnog ulaska u zatvorene dijelove plovila, ali ne i za opremu koja je na otvorenom i relativno lako dostupna, kao što su sidro, konopi, bokobrani, tende, gumenjak, izvanbrodski motor i slično.

S druge strane, neke marine tu odgovornost ne preuzimaju na sebe, nego traže od korisnika da ima odgovarajuće osiguranje od provale i krađe, te da je po svim osnovama osiguran od odgovornosti prema trećim osobama. To je i razumljivo jer su kod nas sve marine otvorenog tipa, što podrazumijeva da osobe koje nisu korisnici marine kroz njih mogu nesmetano prolaziti.

Kako bi ih se odvratilo od neovlaštenog pristupa plovilima, marine uglavnom imaju organiziran sigurnosni nadzor.

S obzirom na to da uvjeti poslovanja u marinama nisu ujednačeni, tako ni ugovori koje pojedine marine potpisuju s korisnicima nisu isti. Bez obzira na to zvao se ugovor o vezu, o korištenju veza, o najmu veza, smještaju plovila ili usluzi veza, predmet tog ugovora najčešće ne podrazumijeva istu uslugu.

Neke marine kao osnovnu uslugu nude samo prostor na kojem je plovilo privezano, pripadajući dio obale za pristup plovilu i mooring, a sve druge usluge, nadgledanje, čuvanje, održavanje, servisiranje ili popravak plovila, nude kao dodatnu uslugu i dodatno naplaćuju, što je i normalno. U nekim je marinama osnovni paket usluge veći i uključuje 24-satni nadzor i čuvanje plovila.

Nejasnoće prizivaju zakone

Dakle, usluga koju marina pruža korisniku može biti od jednostavnog ustupanja prostora za vez do raznih kombinacija usluga, ovisno o njezinim mogućnostima i kapacitetu, a sve bi to trebalo biti definirano ugovorom koji je sastavljen prema općim uvjetima poslovanja dotične marine.

Međutim, ako ugovorene odredbe nisu dovoljno detaljne i jasne, te se iz njih ne može iščitati odgovornost marine za štetu na plovilu, tada bi se možda trebalo osloniti na odgovarajuće zakonske odredbe Zakona o obveznim odnosima, a kod ugovorenog održavanja ili popravaka i odredaba Pomorskog zakonika, pa i Zakona o zaštiti potrošača.

Prema tome, odgovor po pitanju odgovornosti marine za štetu nastalu na vašem plovilu nalazi se u ugovoru o vezu koji ste s tom marinom sklopili. Ako to nije jasno navedeno, konzultirajte se s odvjetnikom.

Korisnik sam godišnjeg veza u marini i do ove godine nisam imao nikakvih problema. Ranije je moj brod bio privezan uvijek na istome mjestu, ispred recepcije, a lani mi je dodijeljen drugi vez, na drugom kraju marine.

Prije ljeta došao sam pripremiti brod i vidio da mi je jedan bok izgreban, a sidro s pramca i još neka oprema iz kokpita ukradeni.

Od marine sam zatražio odštetu, međutim, rekli su mi da na to nemam pravo. Je li to točno?

Ako ste korisnik godišnjeg veza, onda sigurno imate i ugovor u kojem su navedeni odnosi i obaveze vas i marine. To je praksa koju za korisnike mjesečnog ili godišnjeg veza koriste sve marine. Ovi ugovori nisu pravno regulirani posebnom zakonskom odredbom, ali su se kroz poslovnu praksu pojedine marine donekle definirali njezini opći uvjeti poslovanja.

Kako sve marine nisu jednako organizirane, tako ni njihovi uvjeti poslovanja nisu ujednačeni ni standardizirani, a često ni dovoljno precizni ni dorečeni. Jedna od posljedica toga može biti i neujednačena sudska praksa.

Različite odredbe

Ugovori koje koristi većina marina u mnogim su stavkama vrlo slični, međutim, u nekima se i dosta razlikuju. Gotovo u svim ugovorima marine uglavnom preuzimaju odgovornost i nadoknadit će trošak za štete koje su prouzročili njezini djelatnici pri obavljanju poslova, a nikako za štete koje su nanijele treće osobe.

Neke će marine preuzeti odgovornost i za opremu koja je ukradena provalom ili drugim oblikom nasilnog ulaska u zatvorene dijelove plovila, ali ne i za opremu koja je na otvorenom i relativno lako dostupna, kao što su sidro, konopi, bokobrani, tende, gumenjak, izvanbrodski motor i slično.

S druge strane, neke marine tu odgovornost ne preuzimaju na sebe, nego traže od korisnika da ima odgovarajuće osiguranje od provale i krađe, te da je po svim osnovama osiguran od odgovornosti prema trećim osobama. To je i razumljivo jer su kod nas sve marine otvorenog tipa, što podrazumijeva da osobe koje nisu korisnici marine kroz njih mogu nesmetano prolaziti.

Kako bi ih se odvratilo od neovlaštenog pristupa plovilima, marine uglavnom imaju organiziran sigurnosni nadzor.

S obzirom na to da uvjeti poslovanja u marinama nisu ujednačeni, tako ni ugovori koje pojedine marine potpisuju s korisnicima nisu isti. Bez obzira na to zvao se ugovor o vezu, o korištenju veza, o najmu veza, smještaju plovila ili usluzi veza, predmet tog ugovora najčešće ne podrazumijeva istu uslugu.

Neke marine kao osnovnu uslugu nude samo prostor na kojem je plovilo privezano, pripadajući dio obale za pristup plovilu i mooring, a sve druge usluge, nadgledanje, čuvanje, održavanje, servisiranje ili popravak plovila, nude kao dodatnu uslugu i dodatno naplaćuju, što je i normalno. U nekim je marinama osnovni paket usluge veći i uključuje 24-satni nadzor i čuvanje plovila.

Nejasnoće prizivaju zakone

Dakle, usluga koju marina pruža korisniku može biti od jednostavnog ustupanja prostora za vez do raznih kombinacija usluga, ovisno o njezinim mogućnostima i kapacitetu, a sve bi to trebalo biti definirano ugovorom koji je sastavljen prema općim uvjetima poslovanja dotične marine.

Međutim, ako ugovorene odredbe nisu dovoljno detaljne i jasne, te se iz njih ne može iščitati odgovornost marine za štetu na plovilu, tada bi se možda trebalo osloniti na odgovarajuće zakonske odredbe Zakona o obveznim odnosima, a kod ugovorenog održavanja ili popravaka i odredaba Pomorskog zakonika, pa i Zakona o zaštiti potrošača.

Prema tome, odgovor po pitanju odgovornosti marine za štetu nastalu na vašem plovilu nalazi se u ugovoru o vezu koji ste s tom marinom sklopili. Ako to nije jasno navedeno, konzultirajte se s odvjetnikom.

Korisnik sam godišnjeg veza u marini i do ove godine nisam imao nikakvih problema. Ranije je moj brod bio privezan uvijek na istome mjestu, ispred recepcije, a lani mi je dodijeljen drugi vez, na drugom kraju marine.

Prije ljeta došao sam pripremiti brod i vidio da mi je jedan bok izgreban, a sidro s pramca i još neka oprema iz kokpita ukradeni.
